AstraZeneca PLC today announced that it has agreed to settle a patent litigation brought by U. S. patent protection holders, the New Jersey Pharmaceutical Association and the Pfizer Inc. in a $50 million class-action settlement. The settlement is the first of three in a series of cases involving AstraZeneca’s pharmaceuticals patent litigation. In the first case, the U. Court of Appeals for the Federal Circuit issued a ruling on AstraZeneca’s patent for its Vioxx, Celebrex, which is marketed under the trade name Celebrex, in 2002. In the second, the court ruled that the patent for Vioxx, which was based on a formula that claimed to be effective for more than 12 years, was invalid as a matter of law for not patenting an over-the-counter drug as a method for treating patients who were not otherwise adequately informed of the potential risks associated with taking a prescription drug.
The settlement resolves a class-action lawsuit filed in the U. District Court for the Eastern District of Virginia by two AstraZeneca employees claiming that the company’s drug Vioxx had been marketed by AstraZeneca for over 12 years without adequately disclosing the increased risk of cardiovascular and other serious adverse events associated with taking an over-the-counter drug, as well as safety concerns, in the United States.
“We are pleased that the Supreme Court of the United States has issued its decision and today today will consider the resolution of this case. The Supreme Court’s decision in this case,” said U. District Judge John D. Soud cirribed U. District Judge Rebecca C. Johnson. “Today’s decision allows us to proceed to a second stage. In the first step, we will discuss the scope of the patent for the over-the-counter drug. In the second step, we will discuss the issue of whether or not an over-the-counter drug is an invention, and what the FDA is doing to address this.”
The two-year litigation stems from a patent settlement that ended with a $50 million verdict against the company. The case was filed in December 2017 and the parties are scheduled to continue their discussions today. The settlement includes a $50 million share price increase and a 20% royalty fee for each U. patent holder, plus a $3 million settlement amount.
